What is it?

Enable Legal Expenses is our brand-new commercial insurance policy designed specifically for employers. It provides financial and legal back-up in the event they find themselves having to legally defend a claim made against them by an employee.

Why do I need it?

The simple answer is that it protects you, the employer, in case an employee decides to make a claim against you. Employment disputes are often costly and stressful to defend and this is where legal expenses insurance can provide some assistance.

As employment law becomes more complex and our society becomes increasingly litigious, many employers do not know where to turn when faced with an unexpected employment tribunal claim. In 2010 the Ministry of Justice figures showed there were over 236,000 multiple employment claims that went to tribunal – a 56% increase on 2009. When considering this, the need for Legal Expenses Insurance becomes clear.

Of course, no-one takes on the role of an employer expecting a dispute to arise – in the same way no-one would purchase a car expecting to have a motor accident. But like motor insurance, or any insurance for that matter, Enable Legal Expenses Insurance provides the security and peace of mind that you have financial support should the unlikely ever happen.

What does it cover and how much does it cost?

In the unfortunate event of a claim being made by an employee, this insurance policy will cover your legal costs including the appointment of solicitors, barristers and expert witnesses, court costs, professional expenses and awards of compensation. It costs £50 (including Insurance Premium Tax) per annum and the standard limit of indemnity is £100,000 for any one claim.

Policyholders will have telephone access to expert employment lawyers who are on hand to provide practical advice on the employment issue. It is a requirement of the policy that you use these consultants to advise you throughout the dispute and the claim process.
